1. Acceptance of Terms
Welcome to Gitfolio! These Terms of Service ("Terms") constitute a legally binding agreement between you and Gitfolio ("we," "us," or "our") regarding your use of our service available at gitfolio.dcoder.io (the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Gitfolio is an AI-powered developer portfolio generator that:
- Connects to your GitHub and/or GitLab accounts via OAuth authentication
- Analyzes your repositories, commit history, and code contributions
- Uses artificial intelligence (Claude, GPT, or Gemini) to generate professional portfolio content
- Provides multiple portfolio templates tailored to different career goals
- Offers self-hosted GitHub statistics badges
- Enables portfolio sharing and export in various formats
3. Eligibility
To use the Service, you must:
- Be at least 13 years of age
- Have a valid GitHub and/or GitLab account
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
By using the Service, you represent and warrant that you meet these eligibility requirements.
4. Account Registration and Security
4.1 OAuth Authentication
You must authenticate using GitHub or GitLab OAuth. By doing so, you grant us permission to access your repository data as specified in the OAuth authorization scope.
4.2 Account Security
You are responsible for:
- Maintaining the security of your GitHub/GitLab account credentials
- All activities that occur under your Gitfolio account
- Notifying us immediately of any unauthorized access or security breaches
4.3 Account Information
You agree to provide accurate, current, and complete information. We reserve the right to suspend or terminate accounts with false or misleading information.
5. Credits and Payment
5.1 Free Credit
New users receive 1 free credit for portfolio generation. This is a one-time offer and cannot be transferred or refunded.
5.2 Purchasing Credits
- Credits can be purchased through our payment system powered by MercadoPago
- Payment methods include credit/debit cards (international) and PIX (Brazil)
- All prices are displayed in USD or BRL and are subject to change with notice
- Credits are non-transferable and non-refundable except as required by law
5.3 Credit Usage
- Each portfolio generation consumes 1 credit
- Credits do not expire
- Regenerating or editing a portfolio does not consume additional credits
- Failed generations (due to technical errors) will not consume credits
5.4 Refund Policy
Credits are generally non-refundable. However, we may provide refunds at our discretion for:
- Technical failures preventing portfolio generation
- Duplicate charges or billing errors
- Service outages exceeding 24 hours
Refund requests must be submitted within 14 days of purchase to [email protected].
6. Acceptable Use Policy
You agree NOT to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws, regulations, or third-party rights
- Attempt to circumvent payment, rate limiting, or access controls
- Reverse engineer, decompile, or disassemble the Service
- Use automated scripts or bots to access the Service (except for legitimate OAuth)
- Generate portfolios for accounts you do not own without authorization
- Upload malicious code, viruses, or harmful content
- Harass, abuse, or harm other users or our staff
- Scrape, crawl, or systematically extract data from the Service
- Impersonate others or misrepresent your affiliation
- Interfere with or disrupt the Service's infrastructure or networks
Violation of this policy may result in immediate account termination without refund.
7. Intellectual Property Rights
7.1 Your Content
You retain all rights to your repository code and data. By using the Service, you grant us a limited license to:
- Access and analyze your repository data for portfolio generation
- Send your data to third-party AI providers (Anthropic, OpenAI, Google) for processing
- Store generated portfolios on our servers
- Display publicly shared portfolios on our platform
7.2 Generated Content
You own the portfolio content generated by the Service. You may use, modify, and distribute it freely. However:
- AI-generated content may not be unique (other users may receive similar outputs)
- We do not guarantee the accuracy or quality of AI-generated content
- You are responsible for reviewing and editing generated content before use
7.3 Our Intellectual Property
The Service, including its design, code, features, branding, and documentation, is owned by Gitfolio and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works of the Service (except as permitted by open-source licenses)
- Use our trademarks, logos, or branding without written permission
- Remove or alter any proprietary notices
7.4 Open Source
Gitfolio is an open-source project licensed under [LICENSE]. You may use, modify, and distribute the code according to the terms of that license. See our GitHub repository for details.
8. Third-Party Services
The Service integrates with third-party platforms and services:
- GitHub & GitLab: OAuth authentication and repository access (subject to their terms)
- AI Providers: Anthropic Claude, OpenAI GPT, Google Gemini (subject to their terms)
- Payment Processing: MercadoPago (subject to their terms)
- Hosting: Railway (infrastructure provider)
- Analytics: Google Analytics, Microsoft Clarity
We are not responsible for the availability, performance, or privacy practices of these third-party services. Your use of them is governed by their respective terms and policies.
9. Service Availability and Modifications
9.1 Service Availability
We strive to provide reliable service but do not guarantee:
- Uninterrupted or error-free operation
- Specific uptime percentages or SLAs
- Compatibility with all devices, browsers, or platforms
9.2 Maintenance and Downtime
We may perform scheduled or emergency maintenance that temporarily interrupts the Service. We will attempt to provide advance notice when possible.
9.3 Modifications
We reserve the right to:
- Modify, suspend, or discontinue any feature or the entire Service
- Change pricing, credit packages, and payment terms with 30 days' notice
- Update these Terms (see Section 17)
10. Data Privacy and Security
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.
While we implement security measures, no system is completely secure. You acknowledge and accept the inherent risks of transmitting data over the Internet.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Accuracy, reliability, or completeness of AI-generated content
- Continuous, uninterrupted, secure, or error-free operation
- Correction of errors or defects
Some jurisdictions do not allow disclaimers of implied warranties, so some of the above may not apply to you.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GITFOLIO SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages resulting from third-party services (GitHub, AI providers, payment processors)
- Unauthorized access to or alteration of your data
- Any damages exceeding the amount you paid to Gitfolio in the 12 months preceding the claim
Some jurisdictions do not allow limitation of liability, so this may not fully apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Gitfolio, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Violation of these Terms
- Violation of any third-party rights (including intellectual property rights)
- Your repository data or generated content
14. Termination
14.1 Termination by You
You may terminate your account at any time by:
- Disconnecting OAuth access from your dashboard
- Contacting us at [email protected] to request account deletion
14.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice, for:
- Violation of these Terms or Acceptable Use Policy
- Fraudulent or illegal activity
- Non-payment or chargebacks
- Abuse of the Service or harassment of staff/users
- Any reason at our sole discretion
14.3 Effect of Termination
Upon termination:
- Your access to the Service will be revoked
- Unused credits will be forfeited (no refunds unless required by law)
- We may delete your data in accordance with our Privacy Policy
- Sections 7, 11, 12, 13, 15, and 16 of these Terms will survive termination
15. Dispute Resolution
15.1 Informal Resolution
Before filing a claim, you agree to contact us at [email protected] to attempt informal resolution. We will work in good faith to resolve disputes within 60 days.
15.2 Governing Law
These Terms are governed by the laws of [YOUR JURISDICTION], without regard to conflict of law principles.
15.3 Arbitration
Any disputes that cannot be resolved informally will be settled by binding arbitration in accordance with [ARBITRATION RULES]. You agree to arbitrate on an individual basis only (no class actions).

16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gitfolio regarding the Service.
16.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
16.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
16.4 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms to any successor or affiliated entity.
16.5 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, pandemics, Internet outages, third-party service failures, etc.).
17. Changes to Terms
We may update these Terms from time to time. When we do, we will:
- Update the "Last Updated" date at the top of this page
- Notify you via email for material changes (at least 30 days in advance)
- Post a notice on our Service
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and terminate your account.
